Tax Credit Recovery

Our team opens the last 60 months of your tax filings and checks what was paid, invoice by invoice. Ocean Tax is only paid after the credit lands in your account.

Who this work is for Tax Credit Recovery

The work pays off when the company recognizes itself in at least one of these profiles.

  • Companies under Lucro RealThe industry matters little. The tax regime matters: Lucro Real is the Brazilian regime in which tax is assessed on audited results, tax by tax, and that is where five years of unclaimed credit pile up.
  • Operations with a high volume of invoicesManufacturing, agribusiness, distribution and retail are where unclaimed credit tends to accumulate, because the sheer number of transactions hides the error.
  • Companies with five years of historyThe review reaches back 60 months. A younger operation has less ground to reopen, and the recoverable amount falls with it.

What it is Tax Credit Recovery

We audit the last 60 months and find what you paid without owing.

Brazilian tax law is complex enough for a company to pay tax it never owed, almost always because of a credit it never claimed. This shows up at any size, and it shows up even when the bookkeeping is in order.

Our team goes through the accounting records of the last 60 months across your companies and identifies credits that were never claimed and tax that was paid when it was not due. Each opportunity comes out with the calculation base, the legal grounds and an estimate of what can be recovered.

What this solves Tax Credit Recovery

Not every company has credit to recover.

That is why Ocean Tax reviews the bookkeeping before talking about amounts. The analysis goes through tax documents, registrations, calculation bases and filings from the last five years to find opportunities that can be demonstrated and used safely.

What you are left with

  1. A report of the opportunities, one by one
  2. Estimate of the recoverable amount
  3. Presentation meeting
  4. Amendment and clearance of the credit
  5. Follow-up until the credit is used

How it works, from the first meeting to the money

  1. Collecting the data

We ask for the tax data and documents of the last five years. They are the base for everything else, so it is worth sending all of it in one go.

  2. Signing the fee agreement

Before the analysis, the work is formalised: what each side answers for and the confidentiality of everything you hand over go on paper.

  3. Organising the documentation

Our team sorts what arrived and requests what is missing. This is the stage that sets the timing of every other one.

  4. Audit and data cross-checking

We compare the documents the company sent against the accounting records, looking for inconsistencies and irregularities.

  5. Identifying the credits

    two months

Our consultants go through your documentation invoice by invoice, looking for credits the company never used. Along the way we review the tax structure and the entries, and assets and liabilities nobody knew about tend to surface.

  6. Meeting to present the findings

Everything the team found is presented and explained to the departments and the people in charge, opportunity by opportunity.

  7. Deciding what gets done

You decide with us what will be done and how. This is where you sign off on which opportunities to pursue, and you can leave any of them out.

  8. Implementation

Delivery of the calculations and support on the administrative or accounting adjustment. From here the credit follows one of two paths, and the type of credit identified is what decides which.

    From here, two routes

    Amending the tax bookkeeping

Some opportunities require amending the bookkeeping, and that is done inside Ocean Tax. Once the amendments are filed, the credit is either paid in cash or offset through PER/DCOMP, the federal refund and offset system.

Adjustment to offset against future tax

Other opportunities come out with an accounting adjustment in the current month alone. The credit offsets future tax due, including the tax of the very month it is booked.

Common questions

Does my company receive this credit in cash?

It depends. Some credits require amending a filing, and in that case the credit can be paid in cash or offset through PER/DCOMP, the federal refund and offset system. In other cases it serves to offset future tax due, including the tax of the month it is booked.

Is this safe? Does it raise the chance of an audit?

We work with credits provided for in law and with settled positions, and every position comes documented. What raises risk is amending without grounds, and that is exactly the part that stays with us.

How long until the money comes in?

It depends on the tax and on the route. Offsetting tends to be faster than a refund, and a refund can take years. That is why we are conservative about timing: we would rather agree on the realistic scenario upfront.

Do I have to change accountants?

No. The audit works with the material your accountant already produces, and we talk to them directly. If at some point it makes sense to bring the bookkeeping in, that is your decision, not a condition.

Do I need to be in your region to become a client?

No. Ocean Tax serves companies across all of Brazil, fully remotely: tax records are digital and the review does not depend on a site visit. We serve companies in more than 21 states.

Which companies can hire this service?

The tax review is for Lucro Real companies, in any industry. Simples Nacional companies stay out, and under Lucro Presumido the review almost never finds enough to pay for the work: in those cases the conversation usually moves to tax planning or to tax debt management.

Do I have to sign anything before the analysis?

Yes. The analysis starts once the fee agreement is signed, and that agreement is what authorises our team to access five years of your tax bookkeeping. The contract creates no cost: it puts in writing the confidentiality, what each side answers for and the percentage Ocean Tax receives if any credit is recovered. No credit, no bill.

Are you the same as the people who cold call offering tax credit recovery?

You can check all of it without taking our word for anything. Ocean Tax has an address with a physical office, a registered company number and the name of whoever answers for the company in the footer of this site, and whoever signs the work holds a professional licence and answers for it. The analysis takes two months because it is done invoice by invoice, with the legal grounds of each credit in writing. And we turn work down: Simples Nacional companies do not enter, Lucro Presumido almost never pays off, and nothing starts before the contract is signed. Whoever calls promising credit by next week has none of that to show.
